1. Acceptance of Terms

By accessing our website, submitting a form, or booking a consultation or tattoo appointment with Infinity 13 Studio (a DBA of JH2 Enterprises LLC), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or submit your information through any of our forms.

You represent that you are at least 18 years of age. Texas law prohibits tattooing of individuals under the age of 18. Infinity 13 Studio does not perform tattoo services on minors under any circumstances. Valid government-issued photo ID is required at the time of your appointment.

2. Services

Infinity 13 Studio provides professional tattoo and body art services, free consultations, and related communications through our website and messaging platforms. All tattoo pricing is confirmed during your free consultation based on size, placement, and complexity. A shop minimum of $100 applies to all services.

3. Health Disclosure

By booking a consultation or tattoo appointment, you acknowledge that you are responsible for disclosing any medical conditions, allergies, medications (including blood thinners), skin conditions, or other health factors that may affect your ability to safely receive tattoo services. Infinity 13 Studio reserves the right to decline service if a health concern is identified that may pose a risk to the client or artist.

4. Photo & Portfolio Consent

Infinity 13 Studio may photograph completed tattoo work for use in our portfolio, website, and social media channels. If you do not wish to have your tattoo photographed, please notify your artist prior to your appointment. By not opting out, you grant Infinity 13 Studio a non-exclusive, royalty-free license to use images of completed work for promotional purposes.

5. SMS Messaging Terms & Compliance

Program Description

This messaging program sends messages to customers who have booked a consultation or appointment with Infinity 13 Studio through our website at https://infinity13tattoos.app, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with two dedicated, unchecked checkboxes — one for non-marketing messages and one for marketing messages — so users may opt into one, both, or neither.

Booking confirmations

Appointment-related updates (rescheduling, follow-ups)

Marketing Message Types:

Promotional offers and discounts

Studio updates and announcements

Message frequency varies. You may receive up to 5 messages per consultation request.

How Consent Is Collected

SMS consent is collected only when a user explicitly checks an opt-in checkbox on our website forms. Checkboxes are unchecked by default and are never required to submit a form. Providing your phone number alone does not constitute consent to receive SMS messages. Consent to receive SMS is never required to receive services from Infinity 13 Studio.

Cancellation Instructions

You can cancel the SMS service at any time. Simply text STOP to the number from which you received the message. Upon sending STOP, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially and we will resume sending SMS messages to you.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message & Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.

Supported Carriers

Our SMS program works with all major U.S. wireless carriers including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

Age Restriction

You must be 18 years or older to participate in our SMS program.

Data Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent — this information will not be shared with any third parties.

We comply with all applicable laws and regulations including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines regarding the use of SMS communications.

6. Cancellation & No-Show Policy

Consultation appointments are free and require no deposit. For paid tattoo sessions, a deposit may be required to hold your appointment. Cancellations made less than 24 hours before a scheduled appointment may result in forfeiture of the deposit. No-shows without prior notice will forfeit their deposit and may be required to pay a new deposit to rebook.

7. Intellectual Property

This Site and all materials available on the Site are the property of Infinity 13 Studio and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal non-commercial use. You may not modify, copy, reproduce, republish, upload, post, transmit, sell, or distribute any material from the Site without our express written permission.

8. Disclaimers

The information and services offered through the Site are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, Infinity 13 Studio disclaims all warranties including implied warranties of merchantability and fitness for a particular purpose.

Infinity 13 Studio shall not be responsible for any third-party websites, products, or services linked through the Site.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Infinity 13 Studio and its staff shall not be liable for any indirect, incidental, or consequential damages arising out of your use of our services or communications. Our total liability shall not exceed the amount paid by you for services rendered or $100 USD if no purchase has been made.

10. Termination

We reserve the right to terminate or suspend your access to the Site without notice if we determine you have violated these Terms of Service or engaged in conduct we deem inappropriate or unlawful. Upon termination, you must cease all use of the Site and any content obtained from it.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in the State of Texas.

12. Changes to These Terms

We may update these Terms of Service from time to time. The latest version will always be available on our website with the effective date noted above. By continuing to use our services after changes take effect, you agree to be bound by the revised Terms.
